SureClear
Use the SureClear module to identify and resolve potential conflicts of interest. SureClear offers informal and formal conflict searches.
-
Informal conflict searches let users run quick, simple searches to see any obvious matches in your firm's data that may be a conflict of interest. Informal searches can be a predecessor to a formal conflict search process.
-
Formal conflict searches let your conflict management team add parties to client-matters and search those parties against your firm's data to complete a more thorough review of potential conflicts of interest. Formal conflict search results are saved and actions and/or waivers can be applied to the results to track decisions made about individual hits and the final decision from the conflicts review.
As part of formal conflict searches, individuals, companies, or keywords entered as parties are added to client-matters and then those parties are searched for in your existing client-matter data. SureClear includes options to create formal conflict searches for a draft client and draft matter, an existing client and draft matter, or an existing client and existing matter. Following are common usage examples for the available formal search types.
-
When bringing on a new client and your firm does not assign client or matter numbers until the client clears a conflict search, add the related parties to a draft client and draft matter search.
-
When a new business opportunity develops for an existing client, add the related parties to an existing client and draft matter search.
-
As a matter progresses and parties are identified that were not included in the original conflict search, or new parties are added to the matter, add the related parties to an existing client and matter search.
Existing LMS+ workflow processes that include a step for conflict searches are integrated with SureClear. When a workflow form that includes a conflict request is submitted in LMS+, the parties included in that form are synced over to SurePoint Cloud. During the conflict search step in your workflow process, switch to SurePoint Cloud and create a new formal search in SureClear. The parties noted in the LMS+ workflow form are automatically populated when you select the corresponding client and matter. You can then start the search, review the results, and apply applicable actions to results in SureClear to track the final conflict decision needed to complete the conflict search step in the LMS+ workflow process and move to the next step in the process. You can also export the results to a PDF and then attach that file to the workflow in LMS+, if that is part of your firm's process.
All formal conflict searches are saved in SureClear and can be accessed at any time. Search status can be used to track the progress of any conflict search. After search results have been reviewed and a decision about the client or matter has been made, a formal conflict search can be marked as Complete. Completed searches cannot be edited, but they remain available for historical review or re-running later, if needed.
Following are the tasks you can perform in the SureClear module.
A system administrator with access to manage SureClear configuration settings can configure search options to meet your firm's needs before any conflict searches are performed. See SureClear settings.
Note: Ethical walls set up in LMS+ to prevent access to specific clients or matters are enforced in SureClear. The ethical wall message set up in LMS+ may appear on some SureClear screens to protect sensitive client and matter information when performing new conflict searches, reviewing search results, and exporting search results. If a message was not provided when an ethical wall was set up, a default message indicating that the data is hidden due to an ethical wall is used to hide the client and/or matter information. Existing conflict searches and waivers are never visible to users when the user themselves or the user they are working on behalf of is excluded from accessing the associated client and matter due to an ethical wall.
